ResQWare LLC ("we," "us," "our"), the operator of CPR Class Finder, respects the intellectual property rights of others and expects users of the CPR Class Finder website at https://cprclassfinder.us (the "Site") to do the same. This policy describes how to notify us of alleged copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and how we respond.


1. Designated DMCA Agent

We have registered a Designated Agent with the U.S. Copyright Office to receive notices of alleged copyright infringement. The contact information for the Designated Agent is:

2. How to Submit a DMCA Takedown Notice

If you believe that material on the Site infringes your copyright, you may submit a written notice (a "DMCA Notice") to our Designated Agent. To be effective under the DMCA, your Notice must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, you may provide a representative list of those works.
  3. Identification of the allegedly infringing material, with information reasonably sufficient to permit us to locate it on the Site (e.g., the URL of the listing, page, image, or content).
  4. Your contact information, sufficient for us to contact you — including your full legal name, mailing address, telephone number, and, if available, an email address.
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the Notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Send the Notice to our Designated Agent at the address or email in Section 1. We strongly prefer email to expedite processing.

Note: Submitting a knowingly false or misleading DMCA Notice may subject you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).


3. Our Response to a DMCA Notice

Upon receiving a valid DMCA Notice, we will:

  • Remove or disable access to the allegedly infringing material expeditiously
  • Take reasonable steps to notify the user who posted the material (or the training center whose listing contained it) that the material has been removed or disabled
  • Document the Notice in our compliance records

If the Notice does not substantially comply with the DMCA's requirements (see Section 2), we may not be able to act on it. We will, where reasonable, ask you for additional information.


4. Counter-Notification

If you are a user whose content has been removed or disabled in response to a DMCA Notice, and you believe in good faith that the material was removed or disabled by mistake or misidentification, you may submit a written Counter-Notification to our Designated Agent. To be effective, your Counter-Notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your full legal name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which CPR Class Finder may be found, and that you will accept service of process from the person who provided the original DMCA Notice or that person's agent.

Send the Counter-Notification to our Designated Agent.

After we receive a valid Counter-Notification, we will forward it to the party who submitted the original DMCA Notice. If that party does not file a court action seeking a restraining order against you within 10 to 14 business days, we may restore the removed material.

Note: Submitting a knowingly false or misleading Counter-Notification may subject you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).


5. Repeat Infringer Policy

In appropriate circumstances, ResQWare LLC will terminate the accounts of users (including training centers and instructors using the CPR Enroll database whose listings appear on CPR Class Finder) who are repeat copyright infringers. We may also take other action we deem appropriate, including removing content and reporting activity to law enforcement.


6. Other Intellectual Property Claims

For trademark, right-of-publicity, or other non-copyright intellectual property claims, please contact us at [email protected] with the same general categories of information (identification of the right, identification of the allegedly infringing material, your contact information, and a good-faith statement).


7. Changes to This Policy

We may update this DMCA Policy from time to time. The updated version will be posted on the Site with the "Last Updated" date revised.
